Truth in Transportation Trust Funds Act - Excludes the receipts and disbursements allocable to the transportation-related operations of the Highway Trust Fund, the Airport and Airway Trust Fund, and the Inland Waterways Trust Fund from totals of the Federal budget as submitted by the President and from the congressional budget.
Exempts the same amounts from any general statutory budget limitation on Government outlays.
Amends the Congressional Budget and Impoundment Control Act of 1974 to: (1) include these same amounts in fiscal year total revenues and outlays for deficit calculation purposes; and (2) adjust the maximum deficit amount to reflect this new treatment of the affected trust funds.
Makes it out of order in both the Senate and the House of Representatives, in the context of the congressional budget process, to consider changes or recommendations with respect to these trust funds.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. SHORT TITLE. This Act may be cited as the `Truth in Transportation Trust Funds Act'. SEC. 2. BUDGETARY TREATMENT OF TRUST FUND OPERATIONS. (a) IN GENERAL- The receipts and disbursements of the Highway Trust Fund, the Airport and Airway Trust Fund, and the Inland Waterway Trust Fund allocable to the transportation-related operations of each such Trust Fund-- (1) shall not be included in the totals of-- (A) the budget of the United States Government as submitted by the President, or (B) the congressional budget, and (2) shall be exempt from any general budget limitation imposed by statute on expenditures and net lending (budget outlays) of the United States Government. (b) TRANSPORTATION-RELATED OPERATIONS- For purposes of subsection (a), the transportation-related operations-- (1) of the Highway Trust Fund are the disbursements, and the receipts allocable to such disbursements, under-- (A) paragraph (1) of section 9503(c) of the Internal Revenue Code of 1986 (relating to expenditures from the Highway Trust Fund for the Federal-aid highway program), and (B) paragraph (3) of section 9503(e) of such Code (relating to expenditures from the Mass Transit Account); (2) of the Airport and Airway Trust Fund are the disbursements, and the receipts allocable to such disbursements, under paragraph (1) of section 9502(d) of the Internal Revenue Code of 1986 (relating to expenditures from the Airport and Airway Trust Fund for the airport and airway program); and (3) of the Inland Waterways Trust Fund are the disbursements, and the receipts allocable to such disbursements, under section 9506(c) of the Internal Revenue Code of 1986 (relating to the expenditures from the Inland Waterways Trust Fund for navigation construction and rehabilitation projects on inland waterways). SEC. 3. CONFORMING AMENDMENTS AND LIMITATIONS TO THE BUDGET PROCESS. (a) EXEMPTION FROM SEQUESTRATION ORDER- Section 255(g)(1)(A) of the Balanced Budget and Emergency Deficit Control Act of 1985 (2 U.S.C. 905(g)(1)(A)) is amended-- (1) by inserting after the undesignated paragraph relating to activities resulting from private donations, bequests, or voluntary contributions to the Government the following new undesignated paragraph: `Airport and Airway Trust Fund (69-8106-0-7-402; 69-8107-0-7-402; 69-8108-0-7-402; 69-8104-0-7-402);'; and (2) by inserting after the undesignated paragraph relating to health professions graduate student loan insurance fund the following new undesignated paragraphs: `Highway Trust Fund (20-8102-0-7-401; 69-8019-0-7-401; 69-8020-0-7-401; 69-8099-0-7-401); `Inland Waterways Trust Fund (20-8861-0-7-301);'. (b) TREATMENT OF TRUST FUND RECEIPTS FOR DEFICIT CALCULATION PURPOSES- Section 3(6) of the Congressional Budget and Impoundment Control Act of 1974 is amended by adding after the second sentence the following new sentences: `In calculating the deficit for purposes of comparison with the maximum deficit amount under the Balanced Budget and Emergency Deficit Control Act of 1985 and in calculating the excess deficit for purposes of sections 251 and 252 of such Act of 1985 (notwithstanding section 501(a) of the Surface Transportation and Uniform Relocation Assistance Act of 1986) for any fiscal year, the receipts of the Highway Trust Fund (including the Mass Transit Account), the Airport and Airway Trust Fund, and the Inland Waterways Trust Fund allocable to the transportation-related operations of each such Trust Fund for such fiscal year shall be included in total revenues for such fiscal year, and the disbursements allocable to the transportation-related operations of each such Trust Fund for such fiscal year shall be included in total budget outlays for such fiscal year. For purposes of the preceding sentence and paragraph (7), the receipts and disbursements allocable to the transportation-related operations of such Trust Funds shall be those described in section 2(b) of the Truth in Transportation Trust Funds Act.'. (c) ADJUSTMENT OF MAXIMUM DEFICIT AMOUNT- Section 3(7) of the Congressional Budget and Impoundment Control Act of 1974 is amended-- (1) by inserting before the semicolon at the end of subparagraph (F) `plus the receipts of the Highway Trust Fund (including the Mass Transit Account), the Airport and Airway Trust Fund, and the Inland Waterways Trust Fund allocable to the transportation-related operations of each such Trust Fund which the Director of the Congressional Budget Office projects will be credited to each such Trust Fund before October 1, 1991, and minus the disbursements allocable to the transportation-related operations of each such Trust Fund which such Director projects will be made from each such Trust Fund before October 1, 1991'; (2) by inserting before the semicolon at the end of subparagraph (G) `plus such projected receipts and minus such projected disbursements'; and (3) by inserting before the period at the end of subparagraph (H) `plus such projected receipts and minus such projected disbursements'. (d) LIMITATIONS ON CONGRESSIONAL BUDGET PROCESS- Section 310 of the Congressional Budget and Impoundment Control Act of 1974 is amended by adding at the end the following new subsection: `(h) LIMITATION ON CHANGES TO THE HIGHWAY, AIRPORT AND AIRWAY, AND INLAND WATERWAYS TRUST FUNDS- Notwithstanding any other provision of law, it shall not be in order in the Senate or the House of Representatives to consider-- `(1) any concurrent resolution on the budget for any fiscal year, or any amendment thereto or conference report thereon, that assumes or contains in the aggregate totals or functional categories provided for by section 301(a) any amount of budget authority or budget outlays from the Highway Trust Fund, the Airport and Airway Trust Fund, or the Inland Waterways Trust Fund, `(2) any concurrent resolution on the budget for any fiscal year, or any amendment thereto or conference report thereon, that contains reconciliation instructions with respect to the Highway Trust Fund, the Airport and Airway Trust Fund, or the Inland Waterways Trust Fund, or `(3) to consider any reconciliation bill or reconciliation resolution reported pursuant to a concurrent resolution on the budget agreed to under section 301 or 304, or a resolution pursuant to section 254(b) of the Balanced Budget and Emergency Deficit Control Act of 1985, or any amendment thereto or conference report thereon, that contains recommendations with respect to the Highway Trust Fund, the Airport and Airway Trust Fund, or the Inland Waterways Trust Fund.'. (e) CONFORMING ENFORCEMENT PROCEDURES- Sections 302(c), 302(f), 303(a), 311(a), and 402 of the Congressional Budget and Impoundment Control Act of 1974 shall not apply to any bill, resolution, or amendment (including a conference thereon) which provides contract authority or budget outlays from the Highway Trust Fund or the Airport and Airway Trust Fund or budget authority or budget outlays from the Inland Waterways Trust Fund. SEC. 4. EFFECTIVE DATE. This Act (including the amendments made by this Act) shall take effect October 1, 1990, except that the amendments made by section 3(a) shall take effect on March 15, 1990.
