Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. SHORT TITLE. This Act may be cited as the `Organ Transportation Good Samaritan Act'. SEC. 2. LIMITATION ON LIABILITY. (a) IN GENERAL- Any person who transports (voluntarily and without compensation) by air in interstate commerce any human organ for the purpose of assisting a prospective recipient of a human organ transplantation shall not be liable under any State law for any injury, harm, or death to such recipient, the donor of the human organs, or the heirs, successors, or assigns of such recipient or donor resulting from direct or indirect damage to the human organ while it is transported by such person. (b) EXCEPTION- The limitation contained in subsection (a) shall not apply in any case in which the injury, harm, or death is a result of the gross negligence of such person.
