Cargo Survival Act of 1989 - Amends cargo preference provisions of the Merchant Marine Act, 1936 to add nonagricultural cargo, including that generated as a result of a foreign aid cash transfer program, to the list of cargoes which must be carried in U.S.-flag commercial vessels. Requires 100 percent (currently 50 percent) of the types of cargoes listed to be carried in such U.S. vessels, subject to exception.

IN THE HOUSE OF REPRESENTATIVES September 25, 1989 Mr. FIELDS introduced the following bill; which was referred to the Committee on Merchant Marine and Fisheries A BILL To help save the United States maritime industry by increasing the amount of Government cargo carried on American-flag ships. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. SHORT TITLE. This Act may be cited as the Cargo Survival Act of 1989. SEC. 2. REQUIREMENT FOR UNITED STATES-FLAG SHIPMENT OF ALL CARGOES GENERATED BY UNITED STATES. Section 901(b)(1) of the Merchant Marine Act, 1936 (46 U.S.C. App. 1241(b)(1)) is amended in the first sentence-- (1) by inserting `or otherwise generates the ocean-borne transportation of nonagricultural cargo (including as a result of a foreign aid cash transfer program),' before `the appropriate agency'; and (2) by striking `at least 50 per centum' and inserting `, except as provided in subsection (d), 100 per centum'. SEC. 3. REQUIREMENT FOR UNITED STATES-FLAG SHIPMENT OF AGRICULTURAL COMMODITIES. Section 901b(a) of the Merchant Marine Act, 1936 (46 U.S.C. App. 1241f(a)(1), is amended to read as follows: `SEC. 901b. (a) In addition to the requirement for United States-flag carriage established by section 901(b)(1), and except as provided in subsection (d), there shall be transported on United States-flag commercial vessels 100 per centum of the gross tonnage of ocean-borne agricultural cargoes generated by the United States Government, including-- `(A) agricultural commodities or the products thereof specified in subsection (b); and `(B) ocean-borne agricultural cargoes generated as a result of a foreign aid cash transfer program.'. SEC. 4. LIMITATION OF WAIVER OF REQUIREMENT OF SHIPMENT ON UNITED STATES VESSEL. Section 901 of the Merchant Marine Act, 1936 (46 U.S.C. App. 1241) is amended by adding at the end the following: `(d) In authorizing a vessel which is not registered in the United States to transport any cargo which is foreign assistance subject to this section, the Secretary of Transportation shall require that-- `(1) at least 50 per centum of the cargo be transported on vessels which are registered in the United States; and `(2) the remainder of the cargo be transported on vessels registered in the country receiving the foreign assistance.'. SEC. 5. EFFECTIVE DATE. This Act is effective on October 1, 1989.
