Provides that Federal employees who are voluntarily or involuntarily separated from service as a result of the closure or realignment of a military installation under provisions of the Defense Authorization Amendments and Base Closure and Realignment Act shall be eligible for early retirement under the Civil Service and Federal Employees Retirement Systems unless such employees decline a reasonable offer of another position in their employing agency.

IN THE HOUSE OF REPRESENTATIVES November 7, 1989 Mr. HOPKINS introduced the following bill; which was referred to the Committee on Post Office and Civil Service A BILL To amend title 5, United States Code, to provide that Federal employees who are voluntarily or involuntarily separated from service as a result of the closure or realignment of a military installation under title II of the Defense Authorization Amendments and Base Closure and Realignment Act shall be eligible for early retirement. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. AMENDMENTS TO THE CIVIL SERVICE RETIREMENT SYSTEM. (a) GENERALLY- Section 8336 of title 5, United States Code, is amended-- (1) by redesignating subsection (m) as subsection (n); and (2) by inserting after subsection (l) the following: `(m)(1) Except as provided in paragraph (2), an employee who is separated from the service after completing 25 years of service, after becoming 55 years of age and completing 15 years of service, or after becoming 57 years of age and completing 5 years of service, is entitled to an annuity if the employee's separation results from the closure or realignment of a military installation under title II of the Defense Authorization Amendments and Base Closure and Realignment Act, as determined by the Office. `(2) An employee is not entitled to an annuity under this subsection if the employee has declined a reasonable offer of another position in the employee's agency for which the employee is qualified, which is not lower than 2 grades (or pay levels) below the employee's grade (or pay level), and which is within the employee's commuting area.' (b) TECHNICAL AMENDMENT- The first sentence of section 8339(h) of title 5, United States Code, is amended by striking `or (j)' and inserting `(j), or (m)'. SEC. 2. AMENDMENTS TO THE FEDERAL EMPLOYEES' RETIREMENT SYSTEM. (a) GENERALLY- Section 8414 of title 5, United States Code, is amended by adding at the end the following: `(d)(1) Except as provided in paragraph (2), an employee who is separated from the service after completing 25 years of service, after becoming 55 years of age and completing 15 years of service, or after becoming 57 years of age and completing 5 years of service, is entitled to an annuity if the employee's separation results from the closure or realignment of a military installation under title II of the Defense Authorization Amendments and Base Closure and Realignment Act, as determined by the Office. `(2) An employee is not entitled to an annuity under this subsection if the employee has declined a reasonable offer of another position in the employee's agency for which the employee is qualified, which is not lower than 2 grades (or pay levels) below the employee's grade (or pay level), and which is within the employee's commuting area.' (b) TECHNICAL AMENDMENTS- (1) ANNUITY SUPPLEMENT- Section 8421(a)(2) of title 5, United States Code, is amended by striking `(a) or (b)' and inserting `(a), (b), or (d)'. (2) ANNUITY COMMENCEMENT DATE- Section 8464(a)(1)(B) of title 5, United States Code, is amended by striking `(b)(1)(A) or (c)' and inserting `(b)(1)(A), (c), or (d)'.
