Amends the National Environmental Policy Act of 1969 to require the Council on Environmental Quality to promulgate regulations governing the implementation of such Act by Federal agencies, to include requirements for notification procedures for, and public review and cost-effective preparation and dissemination of, environmental impact statements.

IN THE HOUSE OF REPRESENTATIVES November 13, 1989 Mr. HASTERT (for himself, Mr. KYL, Mr. DOUGLAS, Mr. BARNARD, Mr. DONALD E. LUKENS, and Mr. HERGER) introduced the following bill; which was referred to the Committee on Merchant Marine and Fisheries A BILL To provide savings in the compilation and distribution of Federal environmental impact statements, and to ensure the timely notification of all interested parties. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That section 204 of the National Environmental Policy Act of 1969 (42 U.S.C. 4344) is amended-- (1) by striking `and' at the end of paragraph (7); (2) by striking the period at the end of paragraph (8) and inserting in lieu thereof `; and'; and (3) by adding at the end the following new paragraph: `(9) to promulgate regulations governing the implementation of this Act by all Federal agencies (including independent regulatory commissions) which shall include (but are not limited to)-- `(A) the requirement that each such agency, after completion of the scoping process regarding any agency action, notify the Council in writing of-- `(i) its intent to prepare the detailed statement required by section 102(2)(C), and `(ii) the scope and estimated length of that detailed statement, `(B) provisions for public review and comment on the detailed statements required by section 102(2)(C) and, as appropriate, on other documents prepared pursuant to this Act, `(C) standards for the preparation of the detailed statements required by section 102(2)(C) on a cost-effective basis, which shall include the requirement that the agency concerned consult with the Council regarding the preparation of any final detailed statement that will exceed 150 pages, and `(D) standards for the dissemination of detailed statements and other documents prepared pursuant to this Act on a cost effective basis, which shall include requirements that the agency concerned shall-- `(i) by letter provide notification of the availability of a final detailed statement to members of the general public who had contributed substantive written or oral comment regarding the draft of that statement, and `(ii) devise the most cost effective method for the proper dissemination of copies of final detailed statements.'.
