IN THE HOUSE OF REPRESENTATIVES November 20, 1989 Mr. DONNELLY introduced the following bill; which was referred to the Committee on Ways and Means A BILL To amend title II of the Social Security Act to provide a graduated exemption from the public pension offset applicable to certain monthly insurance benefits under such title based on the amount of total monthly benefits received. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. SHORT TITLE. This Act may be cited as the `Social Security Public Pension Offset Amendments Act of 1989'. SEC. 2. GRADUATED REDUCTION IN AMOUNT OF PUBLIC PENSION OFFSET APPLICABLE TO CERTAIN DEPENDENTS' MONTHLY SOCIAL SECURITY INSURANCE BENEFITS. Subsections (b)(4), (c)(2), (e)(7), (f)(2), and (g)(4) of section 202 the Social Security Act (42 U.S.C. 402) are each amended-- (1) in subparagraph (A), by striking `The amount' and inserting `Except as otherwise provided in this paragraph, the amount', and by striking `subparagraph (B)' in clause (ii) and inserting `subparagraph (D)'; (2) by redesignating subparagraphs (B) and (C) as subparagraphs (D) and (E), respectively; and (3) by inserting after subparagraph (A) the following new subparagraphs: `(B) Subparagraph (A) shall not apply with respect to an individual's monthly insurance benefit under this subsection for any month if the total of the amount otherwise subject to reduction under subparagraph (A) for the month and all monthly periodic benefits payable to the individual for such month does not exceed $300. `(C) If the total of the amount otherwise subject to reduction under subparagraph (A) with respect to an individual for any month and all monthly periodic benefits payable to the individual for such month is greater than $300 but less than $600, in applying subparagraph (A), the term `two-thirds' shall be replaced by the term `one-third'.'. SEC. 3. EFFECTIVE DATE. The amendments made by this Act shall apply as if included or reflected in the amendments made by section 337 of the Social Security Amendments of 1983, except that the amendments made by this Act shall apply only with respect to benefits for months beginning after 180 days after the date of the enactment of this Act.
