African Elephant Preservation Act of 1990 - Amends the African Elephant Conservation Act to direct the Secretary of the Interior, if China does not withdraw its reservation under the Convention on International Trade in Endangered Species of Wild Fauna and Flora with respect to listing the African elephant as an endangered species in which trade is strictly regulated, to: (1) certify that fact to the President; and (2) notify the House Committee on Merchant Marine and Fisheries and the Senate Committee on Environment and Public Works.
Deems such certification to be certification under the Fishermen's Protective Act of 1967.
Requires the President, after receiving such certification, to direct the Secretary of the Treasury to prohibit the importation into the United States of fish and wildlife products from China until China has withdrawn the reservation.

IN THE HOUSE OF REPRESENTATIVES April 19, 1990 Mr. FIELDS (for himself and Ms. SCHNEIDER) introduced the following bill; which was referred jointly to the Committees on Merchant Marine and Fisheries and Ways and Means A BILL To amend the African Elephant Conservation Act to prohibit importation of fish and wildlife from the People's Republic of China if that country does not withdraw their reservation regarding listing the African elephant as an endangered species under Appendix I of the Convention on International Trade in Endangered Species of Wild Fauna and Flora. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. SHORT TITLE. This Act may be cited as the `African Elephant Preservation Act of 1990'. SEC. 2. RESERVATION OF PEOPLE'S REPUBLIC OF CHINA REGARDING AFRICAN ELEPHANT. The African Elephant Conservation Act (16 U.S.C. 4201 et seq.) is amended-- (1) by redesignating sections 2305 and 2306 as sections 2306 and 2307, respectively; and (2) by inserting after section 2304 the following: `SEC. 2305. RESERVATION OF PEOPLE'S REPUBLIC OF CHINA REGARDING AFRICAN ELEPHANT. `(a)CERTIFICATION- `(1) IN GENERAL- If, by not later than January 1, 1991, the People's Republic of China does not withdraw its reservation entered under CITES regarding transferring the African elephant to Appendix I of CITES (relating to species threatened with extinction such that trade in those species must be subject to particularly strict regulation in order not to endanger further their survival), the Secretary of the Interior shall-- `(A) certify that fact to the President; and `(B) notify the Committee on Merchant Marine and Fisheries of the House of Representatives and the Committee on Environment and Public Works of the Senate. `(2) FISHERMEN'S PROTECTION ACT OF 1967- Certification by the Secretary of the Interior under paragraph (1)(A) is deemed to be certification under section 8(a)(2) of the Fishermen's Protection Act of 1967 (22 U.S.C. 1978(a)(2)). `(b) PROHIBITION ON IMPORTS OF FISH PRODUCTS AND WILDLIFE PRODUCTS FROM PRC- Not later than 60 days after receiving certification from the Secretary of the Interior under subsection (a), the President shall direct the Secretary of the Treasury to prohibit the importation into the United States of fish products and wildlife products from the People's Republic of China until such time as the President determines that the People's Republic of China has withdrawn the reservation referred to in subsection (a)(1). `(c) DEFINITIONS- In this section, each of the terms `fish products' and `wildlife products' has the meaning that term has in section 8(h) of the Fishermen's Protection Act of 1967 (22 U.S.C. 1978(h)).'.
