Black Lung Benefits Check Delivery Assurance Act of 1989 - Amends the Federal Mine Safety and Health Act of 1977 to provide that if the regularly scheduled delivery date for black lung benefit checks falls on a weekend or a legal public holiday, then such checks shall be mailed for delivery on the first day preceding the weekend or holiday, even if the delivery would be made before the end of the month for which such checks are issued. Provides that if as a consequence of such modified delivery date the payment is more than the correct authorized amount, no action shall be taken to recover the incorrect portion.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. SHORT TITLE. This Act may be cited as the `Black Lung Benefits Check Delivery Assurance Act of 1989'. SEC. 2. EARLY DELIVERY OF BLACK LUNG BENEFITS. The Federal Mine Safety and Health Act of 1977 (30 U.S.C. 801 et seq.) is amended by inserting after section 402 the following new section: `SEC. 403. (a) If the day regularly designated for the delivery of checks used to pay benefits provided under this title falls on a Saturday, Sunday, or legal public holiday (as defined in section 6103 of title 5, United States Code) in any month, the benefit checks that would otherwise be delivered on such day shall be mailed for delivery on the first day preceding such day that is not a Saturday, Sunday, or legal public holiday (as so defined), without regard to whether the delivery of such checks would have to be made before the end of the month for which such checks are issued. `(b) If more than the correct amount of any payment authorized under Federal law is made to any individual solely as a result of the receipt of a benefit check pursuant to subsection (a) before the end of the month for which such check is issued, no action shall be taken to recover such payment or the incorrect portion thereof.'. SEC. 3. APPLICABILITY. The amendment made by this Act shall apply with respect to any benefit check the regularly designated day for delivery of which occurs on or after the day that is 30 days after the date of the enactment of this Act.
