Amends the Federal Salary Act of 1967 to require a record vote on pay adjustments for Members of Congress.

IN THE HOUSE OF REPRESENTATIVES January 24, 1989 Mr. HOCHBRUECKNER introduced the following bill; which was referred jointly to the Committees on Post Office and Civil Service, House Administration, and Rules A BILL To provide that no pay increase for Members of Congress shall take effect under the Federal Salary Act of 1967 unless approved by a recorded vote in each House. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That (a) subsection (i) of section 225 of the Federal Salary Act of 1967 (2 U.S.C. 359) is amended by adding at the end the following: `(3)(A) Any part of the recommendations of the President which relate to offices and positions within the purview of subparagraph (A) of subsection (f) of this section shall not take effect unless approved in accordance with this paragraph. `(B)(i) A pay adjustment for the offices and positions referred to in subparagraph (A) shall be considered approved under this paragraph if, before the end of the 30-day period beginning on the date on which the recommendations of the President are transmitted pursuant to subsection (h) of this section-- `(I) a resolution described in subparagraph (C) is passed by the House of Representatives and the Senate with respect to such adjustment; and `(II) such resolution is approved by the President or otherwise becomes law. `(ii) A resolution which meets the requirements of subclauses (I) and (II) of clause (i) shall be considered approved under this subparagraph as of the date on which it first becomes law. `(C) Any reference to a resolution described in this subparagraph shall be considered to be a reference to a joint resolution of either House of Congress the matter after the resolving clause of which is as follows: `That the Congress approves the pay recommendations transmitted by the President to the Congress on , pursuant to section 225(h) of the Federal Salary Act of 1967, insofar as such recommendations relate to offices and positions within the purview of section 225(f)(A) of such Act.', with the blank space being filled with the appropriate date. `(D)(i) The yeas and nays shall be considered as ordered when the question is put upon final adoption of any resolution described in subparagraph (C). (ii) The provisions of clause (i) are enacted by the Congress-- `(I) as an exercise of the rulemaking power of the Senate and the House of Representatives and as such shall be considered as part of the rules of each House, and shall supersede other rules only to the extent that they are inconsistent therewith; and `(II) with full recognition of the constitutional right of either House to change the rules (so far as they relate to the procedure of that House) at any time, in the same manner, and to the same extent as in the case of any other rule of that House. `(E) Any pay recommendation approved in accordance with the preceding provisions of this paragraph shall take effect with respect to an office or position as of the first day of the first pay period which begins for such office or position after the date referred to in subparagraph (B)(ii).' (b) Section 225 of the Federal Salary Act of 1967 (as amended by subsection (a)) is further amended-- (1) in subsection (f)-- (A) by striking out `the Vice President of the United States,' in subparagraph (A); and (B) by inserting `the Vice President of the United States, and' before `offices' in subparagraph (D); and (2) in subsection (i)(1), by inserting `(other than recommendations with respect to offices and positions within the purview of subparagraph (A) of subsection (f) of this section)' before `shall be effective'. (c) The amendments made by this Act shall be effective with respect to any recommendations transmitted by the President to the Congress after January 8, 1989.
