IN THE HOUSE OF REPRESENTATIVES July 25, 1991 Mr. KENNEDY introduced the following bill; which was referred to the Committee on Energy and Commerce A BILL To amend the Public Utility Holding Company Act of 1935 to permit registered companies and their subsidiaries to engage in energy conservation and load management services, and for other purposes. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION. 1. CONSERVATION AND LOAD MANAGEMENT SERVICES PROVIDED BY UTILITY HOLDING COMPANIES. (a) ENERGY CONSERVATION AND LOAD MANAGEMENT SERVICES AND EQUIPMENT- Notwithstanding section 11(b)(1) of the Public Utility Holding Company Act of 1935, a company registered under that Act, or a subsidiary company of such registered company, may acquire or retain, in any geographic area, an interest in any company primarily engaged, directly or indirectly, in providing energy conservation and load management services or equipment or both to utilities and their customers. Notwithstanding section 11(b)(1) of the Public Utility Holding Company Act of 1935, a subsidiary company of a company registered under such Act primarily engaged, directly or indirectly, in providing energy conservation and load management services or equipment or both to utilities and their customers may conduct such business without regard to, or any limitation based upon, the geographic area in which it operates. (b) DEFINITIONS- As used in this section: (1) The terms `company' and `subsidiary company' shall have the same meanings as defined in section 2(a) of the Public Utility Holding Company Act of 1935. (2) The term `conservation' means any reduction in energy consumption as a result of increases in efficiency of energy use, production, or distribution. (3) The term `load management' means any technique intended to reduce the maximum energy demand on a utility or by a utility customer. (c) SAVINGS PROVISION- Nothing in this section shall be construed to affect the applicability of any provision of the Public Utility Holding Company Act of 1935, other than section 11(b)(1), to the acquisition or retention of any such interest, or the conduct of any such business, by any such company.
