A BILL
Relating to the tariff treatment of theatrical, ballet, and operatic
scenery, properties, and sets.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. THEATRICAL, BALLET, AND OPERATIC SCENERY, PROPERTIES, AND
SETS.
(a) Articles of Wood.--Chapter 44 of the Harmonized Tariff Schedule
of the United States is amended by striking subheading 4421.90.90 and
inserting in numerical sequence the following new superior text and
subheadings, with the article description for subheading 4421.90.94
having the same degree of indentation as the article description in
subheading 4421.90.60:

operatic scenery, properties, or sets... Free

(b) Textile Fabrics Otherwise Impregnated, Coated or Covered.--
Chapter 59 of the Harmonized Tariff Schedule of the United States is
amended by inserting in numerical sequence the following new
subheading, with the article description having the same degree of
indentation as the article description in subheading 5907.00.10:
`` 5907.00.20 To be used in theatrical, ballet, or ............. 83.5%
operatic scenery, properties, or sets... Free ''
(c) Works of Art, Collectors' Pieces.--U.S. Note 1 to Chapter 97 of
the Harmonized Tariff Schedule of the United States is amended--
(1) by striking subsection (b); and
(2) by redesignating subsection (c) as subsection (b).
(d) Theatrical Scenery, Properties, and Apparel.--
(1) In general.--Subchapter XVII of chapter 98 of the
Harmonized Tariff Schedule of the United States is amended by
inserting in numerical sequence the following new heading:
`` 9817.00.98 Theatrical scenery, properties, and apparel
brought into the United States by ''
proprietors or managers of theatrical .
exhibitions arriving from abroad for
temporary use by them in such exhibitions.. Free
(2) Conforming amendment.--Subchapter XIII of chapter 98 of
the Harmonized Tariff Schedule of the United States is amended
by striking heading 9813.00.65.
SEC. 2. APPLICABILITY.
(a) In General.--The amendments made by section 1 apply with
respect to goods entered, or withdrawn from warehouse for consumption,
on or after the 15th day after the date of the enactment of this Act.
(b) Retroactive Provision.--Notwithstanding section 514 of the
Tariff Act of 1930 or any other provision of law to the contrary, upon
a request filed with the appropriate customs officer before the 90th
day after the date of the enactment of this Act, any entry or
withdrawal from warehouse for consumption of goods to which any
amendment made by section 1 applies and that was made--
(1) after December 31, 1992; and
(2) before the 15th day after the date of the enactment of
this Act;
and with respect to which there would have been no duty or a lower duty
if such amendment had applied to such entry or withdrawal, shall be
liquidated or reliquidated as though such entry or withdrawal had
occurred on such 15th day.
