A BILL
To correct the tariff treatment of certain articles covered by the
Nairobi Protocol.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. CERTAIN ARTICLES COVERED BY THE NAIROBI PROTOCOL.
The superior text to subheadings 9817.00.92, 9817.00.94, and
9817.00.96 of the Harmonized Tariff Schedule of the United States is
amended by inserting before the colon the following: ``, parts thereof,
and accessories thereto''.
SEC. 2. APPLICABILITY.
(a) In General.--Except as provided in subsection (b), the
amendment made by section 1 applies with respect to articles entered,
or withdrawn from warehouse for consumption, on or after the 15th day
after the date of the enactment of this Act.
(b) Retroactive Provision.--Notwithstanding section 514 of the
Tariff Act of 1930 or any other provision of law, upon proper request
filed with the appropriate customs officer within 180 days after the
15th day after the date of the enactment of this Act, any entry or
withdrawal--
(1) that was made after August 11, 1985, and before such
15th day; and
(2) with respect to which there would have been no duty if
the amendment made by section 1 applied to such entry or
withdrawal,
shall be liquidated or reliquidated as though such amendment applied to
such entry or withdrawal.
