A BILL
To amend the Fair Labor Standards Act of 1938 to provide an exemption
from that Act for inmates of penal or other correctional institutions
who participate in certain programs.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. EXEMPTION.
Section 13(a) of the Fair Labor Standards Act of 1938 (29 U.S.C.
213(a)) is amended by striking the period at the end of paragraph (15)
and inserting in lieu thereof ``; or'' and by adding after that
paragraph the following:
``(16) any employee who is an inmate of a penal or other
correctional institution and who participates in a correctional
work program which is sanctioned by a State or Federal
corrections agency or which is administered by a nonprofit
organization authorized by State law to conduct a correctional
work program on behalf of the State.''.
SEC. 2. EFFECTIVE DATE.
The amendment made by section 1 shall take effect as of June 25,
1938.
