A BILL
To provide that carriage of an item of equipment to be used under a
Federal contract for cleaning up radioactive waste from the production
of nuclear weapons is not coastwise trade.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. TRANSPORTATION OF ITEM OF EQUIPMENT TO BE USED FOR CLEAN UP
OF NUCLEAR WEAPONS PRODUCTION WASTE.
(a) In General.--Transportation described in subsection (b) shall
not be considered to be coastwise trade for purposes of section 27 of
the Merchant Marine Act, 1920 (46 App. U.S.C. 883), the Act of June 19,
1886 (46 App. U.S.C. 289), section 12106 of title 46, United States
Code, and any other law prohibiting engagement in coastwise trade by a
vessel that is constructed in a foreign country, documented under the
laws of a foreign country, or owned by a person that is not a citizen
of the United States.
(b) Transportation Described.--Transportation referred to in
subsection (a) is carriage by vessel from a point near Oakland,
California, to a point near Brunswick, Georgia, in the period beginning
July 1, 1994, and ending December 1, 1994, of a Bowen spray dryer to be
used under a contract between Westinghouse Savannah River Company and
the Department of Energy in cleaning up radioactive waste from the
production of nuclear weapons at the Savannah River Plant site, South
Carolina.
