A BILL
To authorize the Secretary of Agriculture to provide emergency
financial assistance to agricultural producers who suffer severe crop
losses in federally designated disaster areas.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. EMERGENCY ASSISTANCE FOR AGRICULTURAL PRODUCERS IN DISASTER
AREAS.
(a) Assistance Authorized.--The Secretary of Agriculture may
provide emergency financial assistance to agricultural producers for
crop and operating losses incurred as a result of damages to, or the
destruction of, an agricultural commodity that--
(1) is grown in an area designated as the site of a major
disaster under the Robert T. Stafford Disaster Relief and
Emergency Assistance Act (42 U.S.C. 5121 et seq.);
(2) is normally produced by the producer, but was damaged,
destroyed, or prevented from being planted because of the
natural disaster that was the basis for the designation or
because of conditions directly related to the natural disaster;
and
(3) is not an agricultural commodity that was eligible for
crop insurance coverage under the Federal Crop Insurance Act (7
U.S.C. 1501 et seq.) before the natural disaster.
(b) Use of Existing Authorities.--The Secretary shall use existing
authorities available to the Secretary to provide assistance under
subsection (a). In using such authorities, the Secretary may waive any
provision of law that otherwise prevents an agricultural producer
described in subsection (a) from receiving assistance, except that the
Secretary may not waive crop loss requirements that condition the
receipt of crop insurance or disaster assistance.
(c) Prevention of Duplication.--An agricultural producer may not
receive assistance under subsection (a) if the producer is compensated
for the same loss under any other provision of law.
(d) Effect on Existing Authorities.--The receipt by an agricultural
producer of assistance under subsection (a) shall not be construed to
make the agricultural producer eligible for any other Federal
assistance program.
