Provides that, for any period during FY 1996 or thereafter for which there is a lapse in appropriations for any agency or instrumentality of the Federal Government or the District of Columbia resulting from failure to enact appropriations legislation, there is hereby appropriated to such agencies or instrumentalities from the general fund of the Treasury sufficient amounts to compensate officers and employees performing emergency services involving the safety of human life or the protection of property.

A BILL
To provide for compensation for Federal employees for emergency service
performed during periods of lapsed appropriations.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. COMPENSATION FOR EMERGENCY SERVICE BY FEDERAL EMPLOYEES
PERFORMED DURING PERIODS OF LAPSED APPROPRIATIONS.
For any period, during fiscal year 1996 or any subsequent fiscal
year, for which there is a lapse in appropriations for any agency or
instrumentality of the Federal Government or the District of Columbia
(other than appropriations provided by this section) as a result of a
failure to enact legislation (in the form of a regular appropriations
Act or a continuing resolution) making funds available for compensation
of officers or employees for service performed during such period,
there is hereby appropriated to such agency or instrumentality, from
amounts otherwise available in the general fund of the Treasury, such
sums as are necessary to provide compensation, at the regular rate of
compensation, for such officers or employees for any such service which
is of the type described in section 1342 of title 31, United States
Code (including any service performed pursuant to expressed or implied
authority of law, as defined in opinions issued by the Attorney General
before the date of the enactment of this Act).
SEC. 2. CHARGE TO APPLICABLE ACCOUNTS.
Expenditures made pursuant to this Act shall be charged to the
applicable appropriation, fund, or authorization whenever a bill or
joint resolution in which such applicable appropriation, fund, or
authorization is contained is enacted into law.
SEC. 3. APPLICABILITY.
The provisions of this Act shall apply with respect to service
(described in section 1) performed before, on, or after the date of the
enactment of this Act.
