Amends Federal law to provide that, in any case in which the Secretary of Defense obtains blood samples or other organic matter from an individual that could be used to obtain genetic information concerning that person: (1) such genetic information may be derived from such organic matter or used without that individual's consent only for the purpose of identification of remains; and (2) such individual shall be provided notice of that provision.

A BILL
To amend title 10, United States Code, to limit the collection and use
by the Department of Defense of individual genetic identifying
information for the purpose of identification of remains, other than
when the consent of the individual concerned is obtained.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. LIMITATION ON USE OF GENETIC INFORMATION BY DEPARTMENT OF
DEFENSE.
(a) In General.--Chapter 49 of title 10, United States Code, is
amended by adding at the end the following new section:
``Sec. 983. Use of genetic identifying information: limitation
``(a) Limitation.--In any case in which the Secretary of Defense
obtains from any person blood samples or other organic matter of that
person that could be used to obtain genetic information concerning that
person, such genetic information may be derived from such organic
matter, or used, without the consent of that person only for the
purpose of identification of remains.
``(b) Notice.--Whenever a Department of Defense health care
professional obtains a blood sample or other organic matter from a
person, the person shall be provided notice of the provisions of
subsection (a).''.
(b) Clerical Amendment.--The table of sections at the beginning of
such chapter is amended by adding at the end the following new item:
``983. Use of genetic identifying information: limitation.''.
