Revises specified provisions regarding minimum allocations of Federal aid highway funds and provisions of the Intermodal Surface Transportation Efficiency Act of 1991 (ISTEA) to direct the Secretary of Transportation, in FY 1998 and thereafter, to ensure that each State's percentage of the total apportionments in each such fiscal year and allocations for the prior fiscal year from funds made available out of the Highway Trust Fund (HTF) is not less than the percentage of estimated tax payments to the HTF by highway users in the State in the latest fiscal year for which data are available.
Repeals ISTEA provisions specifying the percentage of total apportioned and allocated funds to be allocated to each State for the surface transportation program.

A BILL
To amend title 23, United States Code, to modify the minimum allocation
formula under the Federal-aid highway program, and for other purposes.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. MINIMUM ALLOCATION.
(a) Fiscal Year 1998 and Thereafter.--Section 157(a) of title 23,
United States Code, is amended by adding at the end the following:
``(5) Thereafter.--In fiscal year 1998 and each fiscal year
thereafter on October 1, or as soon as possible thereafter, the
Secretary shall allocate among the States amounts sufficient to
ensure that a State's percentage of the total apportionments in
each such fiscal year and allocations for the prior fiscal year
from funds made available out of the Highway Trust Fund is not
be less than 100 percent of the percentage of estimated tax
payments attributable to highway users in the State paid into
the Highway Trust Fund in the latest fiscal year for which data
are available.''.
(b) Conforming Amendment.--Section 157(a)(4) of such title is
amended by striking the paragraph designation and all that follows
before ``on October 1'' and inserting the following:
``(4) Fiscal years 1992-1997.--For fiscal years 1992
through 1997,''.
SEC. 2. REPEAL OF HOLD HARMLESS.
(a) In General.--Section 1015(a) of the Intermodal Surface
Transportation Efficiency Act of 1991 (23 U.S.C. 104 note; 105 Stat.
1943-1944) is repealed.
(b) Effective Date.--The amendment made by subsection (a) shall
take effect on the first day of fiscal year 1998.
SEC. 3. 100 PERCENT OF PAYMENT ADJUSTMENTS.
Section 1015(b) of the Intermodal Surface Transportation Efficiency
Act of 1991 (23 U.S.C. 104 note; 105 Stat. 1944) is amended--
(1) in the subsection heading by striking ``90'';
(2) in the paragraph heading for paragraph (1) by striking
``General Rule'' and inserting ``Fiscal years 1992-1997'';
(3) by redesignating paragraph (2) as paragraph (3) and
inserting after paragraph (1) the following:
``(2) Thereafter.--In fiscal year 1998 and each fiscal year
thereafter, the Secretary (after making the allocation under
section 157(a) of this title) shall allocate among the States
amounts sufficient to ensure that a State's percentage of the
total apportionments in each such fiscal year and allocations
for the prior fiscal year from funds made available out of the
Highway Trust Fund is not less than 100 percent of the
estimated tax payments attributable to highway users in the
State paid into the Highway Trust Fund in the latest fiscal
year for which data are available.''; and
(4) in paragraph (3), as redesignated by paragraph (3) of
this section, by striking ``paragraph (1)'' and inserting
``this subsection''.
