      To amend title XIX of the Social Security Act to repeal the 
  preadmission screening and resident review (PASARR) requirement for 
             nursing facilities under the Medicaid program.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. REPEAL OF PREADMISSION SCREENING AND RESIDENT REVIEW 
              (PASARR) REQUIREMENTS FOR MENTALLY-ILL INDIVIDUALS 
              ADMITTED TO NURSING FACILITIES.

    (a) In General.--Section 1919 of the Social Security Act (42 U.S.C. 
1396r) is amended--
            (1) by striking subparagraph (F) of subsection (b)(3);
            (2) in subsection (b)(6), by striking ``, as well as the 
        results of any pre-admission screening conducted under 
        subsection (e)(7)'';
            (3) in subsection (c)(2)(B)(iii)--
                    (A) by adding ``and'' at the end of subclause (II),
                    (B) by striking ``; and'' at the end of subclause 
                (III) and inserting a period, and
                    (C) by striking subclause (IV);
            (4) by striking paragraph (7) of subsection (e);
            (5) by striking paragraph (8) of subsection (f); and
            (6) by redesignating paragraph (9) of subsection (f) as 
        paragraph (8).
    (b) Effective Date.--(1) The amendments made by this section shall 
apply to admissions to nursing facilities occurring on or after the 
date of the enactment of this Act.
    (2) The Secretary of Health and Human Services shall promulgate 
such regulations (on an interim final or similar basis) as may be 
required to carry out the amendments made by this section on a timely 
basis.
