Mr. Ehrlich introduced the following bill; which was referred to the
Committee on Ways and Means, and in addition to the Committee on
Commerce, for a period to be subsequently determined by the Speaker, in
each case for consideration of such provisions as fall within the

A BILL
To amend titles XVIII and XIX of the Social Security Act to repeal
denial of approval of nurse aide training programs based on reasons not
associated with quality or operation.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. REPEAL OF DENIAL OF APPROVAL OF NURSE AIDE TRAINING PROGRAMS
BASED ON REASONS NOT ASSOCIATED WITH QUALITY OR
OPERATION.
(a) In General.--Section 1819(f)(2)(B) of the Social Security Act
(42 U.S.C. 1395i-3(f)(2)(B)) and section 1919(f)(2)(B) of such Act (42
U.S.C. 1396r(f)(2)(B)) are each amended by striking clause (iii) and
the sentence that follows and inserting the following:
``(iii) shall prohibit approval of such a
program that does not comply with the
requirements for nurse aide training and
competency evaluation programs and nurse aide
competency evaluation programs established by
the Secretary under subparagraph (A).''.
(b) Effective Date.--(1) The amendments made by this section shall
apply to programs approved on or after the date of the enactment of
this Act.
(2) The Secretary of Health and Human Services shall promulgate
such regulations (on an interim final or similar basis) as may be
required to carry out the amendments made by this section on a timely
basis.
