Mike Partin Law Enforcement Officers' Protection Act - Amends the Omnibus Crime Control and Safe Streets Act of 1968 to reduce by 25 percent funds available to a State under the drug control and system improvement grant (Byrne) program unless the State has in effect a law which provides for: (1) felony penalties punishable by imprisonment for a term exceeding one year if a motorist or pedestrian who intends to elude or flee knowingly or wantonly disobeys a law enforcement officer's order to stop and the person is fleeing immediately after committing an act of domestic violence, driving under the influence of alcohol or any other substance or combination of substances, driving while his or her driver's license is suspended, or the person, by fleeing or eluding, is the cause of, or creates substantial risk of, death or serious physical injury to any person or property; and (2) criminal penalties punishable by imprisonment for a term of less than one year if a motorist or pedestrian who intends to elude or flee knowingly or wantonly disobeys a law enforcement officer's order to stop, causing or creating a substantial risk of physical injury to a person or property.
Provides for redistribution of any funds to participating States that have such a law in effect. Directs the Attorney General to issue regulations to ensure compliance with this Act.

A BILL
To amend title I of the Omnibus Crime Control and Safe Streets Act of
1968 to reduce the amount of funds to a State that does not have in
effect certain provisions.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Mike Partin Law Enforcement
Officers' Protection Act''.
SEC. 2. AMENDMENT.
(a) Grant Reduction for Noncompliance.--Section 506 of title I of
the Omnibus Crime Control and Safe Streets Act of 1968 is amended by
adding at the end the following:
``(g) Information Access.--
``(1) In general.--The funds available under this subpart
for a State shall be reduced by 25 percent and redistributed
under paragraph (2) unless the State has in effect a law which
provides--
``(A) for felony penalties punishable by
imprisonment for a term exceeding 1 year if--
``(i) a motorist or pedestrian who intends
to elude or flee knowingly or wantonly disobeys
a person recognized to be a law enforcement
officer's order to stop; and
``(ii) one or more of the following
conditions exists--
``(I) the person is fleeing
immediately after committing an act of
domestic violence;
``(II) the person is driving under
the influence of alcohol or any other
substance or combination of substances;
``(III) the person is driving while
the driver's license of such person is
suspended; or
``(IV) by fleeing or eluding, the
person is the cause, or creates
substantial risk, of death or serious
physical injury to any person or
property; and
``(B) for criminal penalties punishable by
imprisonment for a term of less than 1 year if a
motorist or pedestrian who intends to elude or flee
knowingly or wantonly disobeys a person recognized to
be a law enforcement officer's order to stop, causing
or creating a substantial risk of physical injury to a
person or property.
``(2) Redistribution.--Any funds available for
redistribution shall be redistributed to participating States
that have in effect a law referred to in paragraph (1).
``(3) Compliance.--The Attorney General shall issue
regulations to ensure compliance with the requirements of
paragraph (1).''.
(b) Conforming Amendment.--Section 506(a) of title I of the Omnibus
Crime Control and Safe Streets Act of 1968 is amended by striking
``subsection (f),'' and inserting ``subsections (f) and (g),''.
(c) Effective Date.--The amendments made by subsection (a) shall
take effect on the first day of each fiscal year succeeding the first
fiscal year that begins 2 years after the date of the enactment of this
Act.
