A BILL
To respond to drought conditions in various States by authorizing
farmers and ranchers in drought areas to use certain conservation
reserve lands for haying and grazing during the remainder of 1999.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. 1999 EMERGENCY HAYING AND GRAZING ON CERTAIN CONSERVATION
RESERVE PROGRAM ACREAGE.
(a) Haying and Grazing Authorized.--Notwithstanding section
1232(a)(7) of the Food Security Act of 1985 (16 U.S.C. 3832(a)(7)), the
owner or operator of a farm or ranch covered by a contract under
subchapter B of chapter 1 of subtitle D of title XII of such Act (16
U.S.C. 3831 et seq.) may hay and graze, without loss of payments due
under the contract, land that--
(1) is part of that farm or ranch;
(2) is enrolled in the conservation reserve established
under such Act;
(3) is designated as conservation practice 1 land; and
(4) is located in a designated drought disaster area.
(b) Designated Drought Disaster Areas.--In this section, the term
``designated drought disaster area'' means an area that, at any time
during 1999--
(1) was covered by a Presidential declaration of major
disaster issued in response to drought conditions under section
401 of the Robert T. Stafford Disaster Relief and Emergency
Assistance Act (42 U.S.C. 5170); or
(2) determined to be a disaster area by the Secretary under
subpart A of part 1945 of title 7, Code of Federal Regulations
as a result of drought conditions.
(c) Effective Period.--Subsection (a) shall be effective during the
period beginning on the date of the enactment of this Act and ending on
December 31, 1999.
