A BILL
To establish certain procedures regarding the appointment and tenure of
persons to the International St. Lawrence River Board of Control
established by the International Joint Commission under the Boundary
Waters Treaty of 1909.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. APPOINTMENT OF MEMBERS TO INTERNATIONAL ST. LAWRENCE RIVER
BOARD OF CONTROL.
The following shall apply to persons who serve on the United States
section of the International River Board of Control established by the
International Joint Commission under the Order of Approval for
Regulation of Lake Ontario:
(1) Terms.--A term of a member of the Board of Control may
not exceed 2 years, and a person may not serve more than 2
consecutive terms. Members shall be appointed so that the terms
do not terminate in the same year.
(2) Appointment.--(A) Persons under consideration for
appointment to the Board of Control shall be announced publicly
and should be appointed only after an opportunity has been
given to the public to submit comments on the candidates for
appointment.
(B) A person must be approved as a member of the Board of
Control by a recorded vote of a majority of the members of the
International Joint Commission.
(C) The vote must be held in open session.
SEC. 2. PROCEDURES APPLICABLE TO OTHER BOARDS.
The procedures set forth in section 1 shall apply to any other
board or similar body established by the International Joint Commission
to carry out instructions of the Joint Commission with respect to its
functions under the Treaty.
SEC. 3. DEFINITIONS.
In this Act:
(1) International joint commission; joint commission.--The
terms ``International Joint Commission'' and ``Joint
Commission'' mean the International Joint Commission
established under the Treaty Between the United States and
Great Britain Relating to Boundary Waters, and Questions
Arising Between the United States and Canada, of January 11,
1909.
(2) Treaty.--The term ``Treaty'' means the treaty described
in paragraph (1).
(3) Order of approval for regulation of lake ontario.--The
term ``Order of Approval for Regulation of Lake Ontario'' means
the order of Approval for Regulation of Lake Ontario, issued by
the Joint Commission on October 29, 1952, as amended by a
supplementary order of the Joint Commission on July 2, 1956.
