referred to the Committee on Energy and Commerce

A BILL
To amend the Public Health Service Act to provide for programs
regarding ovarian cancer.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Ovarian Cancer Research and
Information Amendments of 2001''.
SEC. 2. RESEARCH ON OVARIAN CANCER.
Section 417B(b)(2) of the Public Health Service Act is amended--
(1) by striking ``cancers.--For the purpose of'' and all
that follows through ``417,'' and inserting the following:
``cancers.--
``(A) For the purpose of carrying out section
417(d),''; and
(2) by adding at the end the following subparagraph:
``(B)(i) For the purpose of carrying out research
under section 417(d) on ovarian cancer, there are
authorized to be appropriated $150,000,000 for fiscal
year 2002, and such sums as may be necessary for each
of the fiscal years 2003 and 2004. With respect to such
purpose, such authorizations of appropriations are in
addition to the authorizations of appropriations
established in subparagraph (A) and in subsection (a).
``(ii) Of the amounts appropriated under clause (i)
for a fiscal year, the Director of the Institute shall
reserve 50 percent for research described in such
clause that does not involve treatment or clinical
trials, and 50 percent for research described in such
clause that does involve treatment and clinical trials.
``(iii) In expending the amounts appropriated under
clause (i) for a fiscal year, the Director of the
Institute shall give priority to the following
activities regarding ovarian cancer:
``(I) Developing a test for the early
detection of the cancer.
``(II) Research to identify precursor
lesions and research to determine the manner in
which benign conditions progress to malignant
status.
``(III) Research to determine the
relationship between the cancer and
endometriosis.
``(IV) Ensuring that, in clinical research
on the cancer that is conducted or supported by
the Institute, appropriate counseling is
provided to women before the women participate
as subjects in the research, including (subject
to changes in the applicable facts) informing
women that there may be a genetic basis to such
cancer.''.
SEC. 3. PUBLIC INFORMATION AND EDUCATION ON OVARIAN CANCER.
Section 417(d)(4) of the Public Health Service Act is amended by
striking ``section 413; and'' and inserting the following: ``section
413, which programs shall include programs on ovarian cancer that
(subject to changes in the applicable facts) provide information and
education regarding--
``(A) screening procedures for such cancer,
including the fact that there is not a procedure that
reliably provides for the early detection of such
cancer;
``(B) the fact that there may be a genetic basis to
such cancer;
``(C) factors indicating a substantial risk of such
cancer; and
``(D) the various treatments for such cancer and
the extent to which the treatments are effective;
and''.
SEC. 4. MEMBERSHIP OF NATIONAL CANCER ADVISORY BOARD.
The membership of the National Cancer Advisory Board under section
406(h)(2) of the Public Health Service Act shall include one or more
individuals who are at high risk for developing ovarian cancer.
SEC. 5. EFFECTIVE DATE.
This Act takes effect October 1, 2001, or upon the date of the
enactment of this Act, whichever occurs later.
