To amend the Harmonized Tariff Schedule of the United States to provide
separate subheadings for low-energy magnets and articles containing
magnets and to create additional U.S. notes explaining the tariff
classification of low-energy magnets and articles containing magnets.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. LOW-ENERGY MAGNETS AND ARTICLES INCLUDING MAGNETS.
(a) In General.--
(1) Heading 3924 of the Harmonized Tariff Schedule of the
United States is amended by inserting in numerical sequence the

(b) Low-Energy Magnets.--
(1) In general.--The Additional U.S. Notes to chapter 85 of
the Harmonized Tariff Schedule of the United States are
amended--
(A) by redesignating notes 2 through 13 as notes 3
through 14, respectively; and
(B) by inserting after note 1 the following new
note:
``2. For the purposes of heading 8505, the term `flexible magnets'
refers to magnets of thirty millionth of an inch thick that can
be wrapped around a twelve inch radius without breaking. The
term `flexible magnets' includes products made of magnetic or
magnetic receptive powder of metal or nonmetallic substances
(e.g., strontium, ferrite, iron, etc.) agglomerated with rubber
or plastics or with any other substances used as binders. Such
articles may be rendered permanently magnetic or may be
intended to be magnetized.''.
(c) Staged Rate Reductions.--Any staged reduction--
(1) of a rate of duty set forth in any subheading of the
Harmonized Tariff Schedule of the United States that is listed
in column A,
(2) that was proclaimed by the President before the date of
the enactment of this Act, and
(3) that is scheduled to take effect on or after such date
of enactment, or that would take effect on or after such date
but for the amendments made by subsection (a),
shall apply to the corresponding rate of duty set forth in the
subheading of such Schedule that is listed in colum B opposite such
column A subheading:

(d) Effective Date.--The amendments made by this section shall
apply with respect to articles entered, or withdrawn from warehouse for
consumption, on or after the 15th day after the date of the enactment
of this Act.
