To amend the Endangered Species Act of 1973 to establish requirements for the designation of critical habitat in Hawaii, and for other purposes.

Amends the Endangered Species Act of 1973 to prohibit a designation of an area in Hawaii as critical habitat of a species from taking effect before: (1) the Secretary has developed a recovery plan for the species; and (2) the designation, including the scientific data on which it is based, is reviewed by the National Academy of Sciences. Provides that a recovery plan shall not apply to any area in Hawaii before the Academy has reviewed it, including the underlying scientific data.

 To amend the Endangered Species Act of 1973 to establish requirements 
   for the designation of critical habitat in Hawaii, and for other 
                               purposes.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. REQUIREMENTS FOR DESIGNATION OF CRITICAL HABITAT IN HAWAII.

    Section 4 of the Endangered Species Act of 1973 (16 U.S.C. 1533) is 
amended by adding at the end the following:
    ``(j) Requirements for Designation of Critical Habitat in Hawaii.--
A designation of an area in Hawaii as critical habitat of a species 
shall not take effect before the date on which--
            ``(1) the Secretary has developed a recovery plan under 
        subsection (f) for the species; and
            ``(2) the designation, including the scientific data on 
        which the designation is based, is reviewed by the National 
        Academy of Sciences.''.

SEC. 2. REQUIREMENT OF SCIENTIFIC REVIEW OF RECOVERY PLANS.

    Section 4(f) of the Endangered Species Act of 1973 (16 U.S.C. 1533) 
is amended by adding at the end the following:
    ``(6) A recovery plan shall not apply to any area in Hawaii before 
the date the plan, including the scientific data on which the plan is 
based, is reviewed by the National Academy of Sciences.''.
