naturally occurring retirement communities.

the following bill; which was referred to the Committee on Education

A BILL
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Naturally Occurring Retirement
Community (NORC) Support Act''.
SEC. 2. AMENDMENTS.
The Older Americans Act of 1995 (42 U.S.C. 3001 et seq) is
amended--
(1) by inserting before section 401 the following:
``TITLE IV--RESEARCH, TRAINING, AND RELATED MATTERS'',
and
(2) by inserting after section 421 the following:
``SEC. 422. NATURALLY OCCURRING RETIREMENT COMMUNITIES.
``(a) Program Authorized.--The Assistant Secretary shall make
grants to public and private agencies and organizations to provide
comprehensive supportive services to older individuals who reside in
noninstitutional residences (excluding residences for which assistance
is provided under section 202 of the National Housing Act of 1959 (12
U.S.C. 1701q)) in naturally occurring retirement communities, for
purposes of enhancing the quality of life of such individuals and
reducing the need to institutionalize such individuals.
``(b) Use of Funds.--In each fiscal year for which funds are
appropriated to carry out this section, the Assistant Secretary shall--
(1) make grants to not fewer than 5, and not more than 8,
public and private agencies and organizations that submit to
the Assistant Secretary an application in such form, and
containing such information, as the Assistant Secretary may
require by rule, including an assurance that the applicant will
use such grant to supplement and not supplant resources
otherwise available to such applicant to provide supportive
services to older individuals; and
``(2) give priority to agencies and organizations that
provided comprehensive supportive services in fiscal year 2002
to older individuals who resided in noninstitutional residences
(excluding residences for which assistance is provided under
section 202 of the National Housing Act of 1959 (12 U.S.C.
1701q)) in naturally occurring retirement communities, for
purposes of enhancing the quality of life of such individuals
and reducing the need to institutionalize such individuals.
``(c) Definition.--For purposes of this section, the term
`naturally occurring retirement community' means a geographical area in
which not less than 40 percent of the noninstitutional residences are
occupied for not less than 10 years by heads of households who are
older individuals, but does not include residences for which assistance
is provided under section 202 of the National Housing Act of 1959 (12
U.S.C. 1701q)).
``(d) Report.--Not later than 3 years after the 1st fiscal year for
which funds are appropriated to carry out this section, the Assistant
Secretary shall--
``(1) carry out an evaluation of the progress and
development of supportive services provided with grants made
under this section; and
``(2) submit to the Congress a report--
``(A) summarizing the results of such evaluation;
and
``(B) containing such recommendations as the
Assistant Secretary considers to be appropriate.
``(e) Authorization of Appropriations.--There are authorized to be
appropriated to carry out this section, $10,000,000 for fiscal year
2003 and such sums as may be necessary for fiscal years 2004, 2005,
2006, and 2007.''.
