A BILL
To support the public educational programs of the Army Aviation
Heritage Foundation by amending title 10 of the United States Code to
elevate the status of the Army Aviation Heritage Foundation to receive
surplus military property.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SPECIFIC ELIGIBILITY OF ARMY AVIATION HERITAGE FOUNDATION TO
RECEIVE SURPLUS MILITARY PROPERTY.
(a) Title 10 Authority.--Section 2572 of title 10, United States
Code, is amended--
(1) in subsection (a), by adding at the end the following
new paragraph:
``(8) The Army Aviation Heritage Foundation, a nonprofit
organization incorporated in the State of Georgia.''; and
(2) in subsection (d)(2)--
(A) in subparagraph (B), by striking ``a recognized
war veterans' association'' and inserting ``an entity
described in paragraph (5) or (8) of subsection (a)'';
and
(B) by adding at the end the following new
subparagraph:
``(C) In the case of the donation of an aircraft or other surplus
equipment to the entity described in paragraph (8) of subsection (a)
that is in flyable or usable condition at the time the aircraft or
equipment is determined to be available for donation under this
section, the Secretary concerned shall maintain the aircraft or
equipment in flyable or usable condition pending the donation to
facilitate the prompt utilization of the aircraft or equipment by the
entity in its aerial and educational living history demonstrations.''.
(b) Designation As Service Educational Activity.--The Army Aviation
Heritage Foundation, a nonprofit organization incorporated in the State
of Georgia, is hereby designated as a Service Educational Activity for
purposes of the Department of Defense personal property donation
program, and the Secretary of Defense shall enter into a formal
donation agreement with the Army Aviation Heritage Foundation.
