A BILL
To amend title 49, United States Code, relating to explanations by air
carriers of flight delays, cancellations, and diversions.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Airline Customer Notification Act''.
SEC. 2. AIRLINE PASSENGER PROTECTION.
(a) In General.--Subchapter I of chapter 417 of title 49, United
States Code, is amended by adding at the end the following:
``Sec. 41722. Air carrier passenger protection
``(a) Explanation of Delay, Cancellation, or Diversion.--
``(1) Announcement.--An announcement by an air carrier of
(1) a delay of 2 or more hours or cancellation of a flight, (2)
a diversion of a flight to an airport other than the airport at
which the flight is scheduled to land, or (3) a delay of 1 or
more hours in deplaning following the touchdown of an aircraft
at an airport shall include an explanation of the reason or
reasons for the delay, cancellation, or diversion and, in the
case of a delay, the expected length of the delay.
``(2) Request.--Upon request of a passenger on flight with
respect to which an announcement subject to paragraph (1) is
made by an air carrier, the carrier shall provide a written
copy of the explanation included in such announcement.
``(3) Notice.--Each air carrier shall post at the gate or
at the ticket counter, or both, a notice of the right of a
passenger on a flight with respect to which an announcement
subject to paragraph (1) is made by the carrier to request a
written copy of any explanation included in such announcement.
``(b) Prohibition on False or Misleading Explanations.--No air
carrier shall provide an explanation under subsection (a) that the air
carrier knows or has reason to know is false or misleading.''.
(b) Conforming Amendment.--The analysis for such chapter is amended
by inserting after the item relating to section 41721 the following:
``41722. Air carrier passenger protection.''.
