Foreign Truck Safety Act

Foreign Truck Safety Act - Amends Federal transportation law to prohibit foreign commercial motor vehicles that enter the United States along the U.S.-Mexico border from operation in the United States by a foreign motor carrier or a foreign motor private carrier unless such vehicles have passed, in the 12-month period preceding entry into the United States, a federally-ordered safety equipment inspection. Authorizes the Secretary of Transportation or a State to impose and collect a fee on such carriers to cover the costs of such inspections.

   To amend title 49, United States Code, relating to inspection of 
 commercial motor vehicles entering the United States along the United 
             States-Mexico border, and for other purposes.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ``Foreign Truck Safety Act''.

SEC. 2. AMENDMENT TO TITLE 49.

    Section 31142 of title 49, United States Code, is amended by adding 
at the end the following:
    ``(g) Inspection of Certain Motor Vehicles.--
            ``(1) Requirement.--No commercial motor vehicle that enters 
        the United States along the United States-Mexico border after 
        the 90th day following the date of enactment of this subsection 
        may be operated in the United States by a foreign motor carrier 
        or a foreign motor private carrier (as such terms are defined 
        under section 13102) unless such vehicle has passed, in the 12-
        month period preceding such entry into the United States, an 
        inspection under subsection (a).
            ``(2) Fees.--The Secretary or a State conducting 
        inspections to carry out this subsection may impose and collect 
        such fees on foreign motor carriers and foreign motor private 
        carriers as may be necessary to cover the costs of such 
        inspections.
            ``(3) Limitations on statutory construction.--Nothing in 
        this subsection shall be construed to--
                    ``(A) prohibit a commercial motor vehicle from 
                being operated without compensation in the United 
                States for the sole purpose of reaching the place of 
                inspection closest to its border crossing point; and
                    ``(B) authorize the operation of a commercial motor 
                vehicle in the United States by a foreign motor carrier 
                or a foreign motor private carrier if such vehicle has 
                failed its most recent inspection under subsection (a) 
                and has not had the necessary repairs to correct the 
                defects identified in such inspection.''.
