A BILL
To amend subpart 2 of part J of title X of the Elementary and Secondary
Education Act of 1965 to make improvements to the rural education
achievement program.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Rural Education Initiative
Amendments Act of 2001''.
SEC. 2. RURAL EDUCATION INITIATIVE.
(a) Authorization of Appropriations.--Section 10973 of the
Elementary and Secondary Education Act of 1965 (20 U.S.C. 8292) is
amended by striking ``62,5000,000 for fiscal year 2001'' and inserting
``$150,000,000 for fiscal year 2002 and such sums as may be necessary
for each of the 4 succeeding fiscal years''.
(b) Formula Grant Program.--Section 10974 of the Elementary and
Secondary Education Act of 1965 (20 U.S.C. 8293) is amended--
(1) in subsection (a)(1), by striking ``to carry out local
activities authorized in part A of title I, section 2210(b),
section 3134, or section 4116'' and inserting ``to support
local or statewide education reform efforts intended to improve
the academic achievement of elementary and secondary school
students and the quality of instruction provided to such
students''.
(2) in subsection (b)(2), by inserting ``, except that the
Secretary may waive the School Locale Code requirement of this
paragraph if the Secretary determines, based on certification
provided by the local educational agency or the State
educational agency on behalf of the local educational agency,
that the local educational agency is located in an area defined
as rural by a governmental agency of the State'' before the
period at the end; and
(3) in subsection (c), by striking ``and VI, except for
funds made available under section 321 of the Department of
Education Appropriations Act, 2001'' and inserting ``VI,
section 307 of the Department of Education Appropriations Act,
1999, parts A and C of title VII, and part A of this title''.
(c) Competitive Grant Program.--Section 10975 of the Elementary and
Secondary Education Act of 1965 (20 U.S.C. 8294) is amended--
(1) in subsection (a), by striking ``to carry out local
activities authorized in part A of title I, section 2210(b),
section 3134, or section 4116'' and inserting ``to support
local or statewide education reform efforts intended to improve
the academic achievement of elementary and secondary school
students and the quality of instruction provided to such
students''.
(2) in subsection (b)(2), by inserting ``, except that the
