and Mr. Dodd) introduced the following bill; which was read twice and
referred to the Committee on Health, Education, Labor, and Pensions

A BILL
To amend subtitle C of title I of the National and Community Service
Act of 1990 to give more youth aging out of foster care the opportunity
to participate in national service programs, and for other purposes.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Fostering Service Act of 2002''.
SEC. 2. AMENDMENTS TO NATIONAL AND COMMUNITY SERVICE ACT OF 1990.
The National and Community Service Act of 1990 is amended--
(1) in section 101 (42 U.S.C. 12511), by adding at the end
the following:
``(30) Youth aging out of foster care.--The term `youth
aging out of foster care' means children who are--
``(A) leaving foster care because such children
have attained the maximum age for foster care
eligibility in a State; and
``(B) transitioning to independent living, as
determined by the Corporation.'';
(2) in section 122(a) (42 U.S.C. 12572(a))--
(A) in paragraph (2)(B), by striking ``too old for
foster care,'' and inserting ``too old for foster care,
youth aging out of foster care,'';
(B) by redesignating paragraph (15) as paragraph
(16); and
(C) by inserting after paragraph (14) the
following:
``(15) A community service program designed to engage
former foster care youth as mentors for youth aging out of
foster care.'';
(3) in section 125(a) (42 U.S.C. 12575(a))--
(A) in paragraph (5), by striking ``and'';
(B) in paragraph (6), by striking the period at the
end and inserting ``; and''; and
(C) by adding at the end the following:
``(7) improve the ability of national service programs--
``(A) to recruit and retain youth aging out of
foster care as participants in such programs; and
``(B) to integrate such youth with other
participants in such programs.'';
(4) in section 130(b)(5) (42 U.S.C. 12582(b)(5)), by
striking ``disabilities and economically disadvantaged young
men and women'' and inserting ``disabilities, economically
disadvantaged young men and women, and youth aging out of
foster care'';
(5) in section 131(b)(2) (42 U.S.C. 12583(b)(2))--
(A) in subparagraph (A), by striking ``and'' at the
end; and
(B) by adding at the end the following:
``(C) to those participants who are youth aging out
of foster care to assist such participants in making
the transition to independent living; and'';
(6) in section 138(d) (42 U.S.C. 12592(d)), in the second
sentence, by striking ``offices,'' and inserting ``offices,
State and local agencies that provide services to youth in
foster care and youth aging out of foster care,''; and
(7) in section 501(a)(2)(A) (42 U.S.C. 12681(a)(2)(A)), by
adding at the end the following: ``The amounts authorized to be
appropriated under this subparagraph shall include an
additional amount of $5,000,000 for fiscal year 2003 to carry
out the amendments made by the Fostering Service Act of
2002.''.
