A BILL
To amend title 10, United States Code, to provide increased access to
military commissary stores for members of the Ready Reserve, persons
who would be eligible for military retired pay (but for the fact that
they are under 60 years of age), and their dependents.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. COMMISSARY BENEFITS FOR MEMBERS OF THE READY RESERVE AND
PERSONS OTHERWISE QUALIFIED FOR RETIRED PAY, BUT UNDER
AGE 60.
(a) Ready Reserve Members.--Section 1063 of title 10, United States
Code, is amended--
(1) in subsection (a)--
(A) by striking ``Defense.'' and inserting ``during
that calendar year on the same basis as members of the
armed forces on active duty.''; and
(B) by striking the second sentence;
(2) in subsection (b), by striking paragraph (3);
(3) by redesignating subsection (d) as subsection (e); and
(4) by inserting after subsection (c) the following new
subsection (d):
``(d) Dependents.--(1) Dependents of a member who is authorized
under subsection (a) to use commissary stores shall be authorized to
use such stores on the same basis as dependents of members on active
duty.
``(2) Dependents of a member who is authorized under subsection (b)
to use commissary stores shall be authorized to use such stores on the
same basis as the member.''.
(b) Persons Otherwise Qualified for Nonregular Service Retired Pay,
but Under Age 60.--Section 1064 of such title is amended to read as
follows:
``Sec. 1064. Use of commissary stores: persons qualified for retired
pay under chapter 1223 but under age 60
``(a) Eligibility of Persons.--A person who would be eligible for
retired pay under chapter 1223 of this title but for the fact that the
person is under 60 years of age shall be authorized to use commissary
stores of the Department of Defense on the same basis as members of the
armed forces entitled to retired pay.
``(b) Dependents.--Dependents of a person who is authorized under
subsection (a) to use commissary stores shall be authorized to use such
stores on the same basis as dependents of members entitled to retired
pay.
``(c) Regulations.--The Secretary of Defense shall prescribe
regulations to carry out this section.''.
