Every Child is Created Equal Act of 2003 - Amends the Elementary and Secondary Education Act of 1965 (ESEA) to require school improvement plans to include a statement that providers of supplemental educational services (SES), as recipients of Federal funds, are subject to certain ESEA civil rights provisions that prohibit discrimination. Requires SES providers, as recipients of Federal funds, to meet all applicable Federal, State, and local health, safety, and civil rights laws.
Prohibits construing anything in ESEA provisions for SES as permitting discrimination based on religion with respect to employment or provision of services.
Requires SES providers to serve all eligible students, including students with disabilities and limited English proficient students.

A BILL
To amend the Elementary and Secondary Education Act of 1965 to prohibit
federally subsidized discrimination in supplemental educational
services, and for other purposes.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Every Child is Created Equal Act of
2003''.
SEC. 2. PROHIBITION OF FEDERALLY SUBSIDIZED DISCRIMINATION IN
SUPPLEMENTAL EDUCATIONAL SERVICES.
(a) Supplemental Education Services.--Subsection (e) of section
1116 of the Elementary and Secondary Education Act of 1965 (20 U.S.C.
6316) is amended--
(1) in paragraph (3)--
(A) in subparagraph (D), by striking ``and'' after
the semicolon at the end;
(B) in subparagraph (E), by striking the period at
the end and inserting ``; and''; and
(C) by adding at the end the following new
subparagraph:
``(F) specifically state that, as a recipient of
Federal funds, the provider is subject to section
9534.''.
(2) in paragraph (5)(C), by inserting before the period the
following: ``as a recipient of Federal funds''; and
(3) in paragraph (9), by inserting before the period the
following: ``or permit discrimination based on religion with
respect to employment or provision of services''.
(b) Civil Rights.--Subsection (a) of section 9534 of the Elementary
and Secondary Education Act of 1965 (20 U.S.C. 7914) is amended to read
as follows:
``(a) In General.--Discrimination on the basis of race, color,
religion, sex (except as otherwise permitted under Title IX of the
Education Amendments of 1972), national origin, or disability in any
program funded under this Act is prohibited.''.
SEC. 3. SUPPLEMENTAL EDUCATIONAL SERVICES PROVIDERS TO SERVE ALL
ELIGIBLE STUDENTS.
Paragraph (1) of section 1116(e) of the Elementary and Secondary
Education Act of 1965 (20 U.S.C. 6316(e)) is amended by inserting after
``eligible children'' the following: ``(including students with
disabilities and limited English proficient students)''.
