State and Local Government Election Administration Act of 2004 - Amends the the Help America Vote Act of 2002 to postpone the deadline by which a State is required to meet the election administration requirements of the Act until the total amount appropriated to the State for requirements payments under the Act is equal to or greater than the costs incurred by the State in meeting such requirements.
Declares that no State (or local government) shall be required to meet any of such election administration requirements until the later of: (1) the first day of the first calendar year which begins after the aggregate amount appropriated to the State for requirements payments for all fiscal years is equal to or greater than the costs incurred by the State in meeting such requirements; or (2) the applicable date otherwise provided.

A BILL
To amend the Help America Vote Act of 2002 to postpone the deadline by
which a State is required to meet the election administration
requirements of the Act until the total amount appropriated to the
State for requirements payments under the Act is equal to or greater
than the costs incurred by the State in meeting such requirements.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``State and Local Government Election
Administration Act of 2004''.
SEC. 2. POSTPONEMENT OF DEADLINE FOR ELECTION ADMINISTRATION
REQUIREMENTS.
(a) In General.--Subtitle A of title III of the Help America Vote
Act of 2002 (42 U.S.C. 15481 et seq.) is amended by adding at the end
the following new section:
``SEC. 306. DELAY IN IMPLEMENTATION UNTIL FULL FUNDING OF COSTS
INCURRED.
``Notwithstanding any other provision of this title, no State (or
jurisdiction within the State) shall be required to meet any of the
requirements of this title until the later of--
``(1) the first day of the first calendar year which begins
after the aggregate amount appropriated to the State for
requirements payments for all fiscal years under section 257 is
equal to or greater than the costs incurred by the State in
meeting the requirements of this title; or
``(2) the applicable date otherwise provided under this
title.''.
(b) Clerical Amendment.--The table of contents for subtitle A of
title III of such Act is amended by adding at the end the following:
``Sec. 306. Delay in implementation until full funding of costs
incurred.''.
(c) Effective Date.--The amendments made by this section shall take
effect as if included in the enactment of the Help America Vote Act of
2002.
