To amend the provision regarding the emergency watershed protection program in the Department of Defense, Emergency Supplemental Appropriations to Address Hurricanes in the Gulf of Mexico, and Pandemic Influenza Act, 2006, to restore the discretion of the Secretary of Agriculture to waive or reduce the non-Federal cost share requirements of the program.

Amends the Department of Defense, Emergency Supplemental Appropriations to Address Hurricanes in the Gulf of Mexico, and Pandemic Influenza Act, 2006 to authorize the Secretary of Agriculture to waive or reduce the emergency watershed protection program non-federal cost share requirement if the Secretary determines that immediate action is or was required for environmental or safety concerns and the local partner cannot or could not financially participate.

  To amend the provision regarding the emergency watershed protection 
     program in the Department of Defense, Emergency Supplemental 
    Appropriations to Address Hurricanes in the Gulf of Mexico, and 
    Pandemic Influenza Act, 2006, to restore the discretion of the 
Secretary of Agriculture to waive or reduce the non-Federal cost share 
                      requirements of the program.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. CONSISTENT COST-SHARING REQUIREMENTS UNDER EMERGENCY 
              WATERSHED PROTECTION PROGRAM.

    Section 102 of title I of division B of Public Law 109-148 (119 
Stat. 2748) is amended--
            (1) by redesignating subsections (c) and (d) as subsections 
        (d) and (e), respectively; and
            (2) by inserting after subsection (b) the following new 
        subsection (c):
    ``(c) Waiver or Reduction of Cost-Share Requirement.--The Secretary 
of Agriculture may waive or reduce the non-Federal cost share 
requirement imposed by subsection (b) in cases in which the Secretary 
determines that immediate action is or was required for environmental 
or safety concerns and the local partner cannot or could not 
financially participate.''.
