Amends the Intelligence Reform and Terrorism Prevention Act of 2004 to direct the Secretary of the Treasury, for each of fiscal years 2006 through 2010, to make available to the Secretary of Homeland Security necessary funding to ensure a 20 percent increase in each such fiscal year in the number of border patrol agents.

A BILL
To amend section 5202 of the Intelligence Reform and Terrorism
Prevention Act of 2004 to provide for assured funding for more Border
Patrol agents.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. ASSURANCE OF ADEQUATE FUNDING FOR MORE BORDER PATROL AGENTS.
Section 5202 of the Intelligence Reform and Terrorism Prevention
Act of 2004 (Public Law 108-458) is amended--
(1) by striking ``In each of'' and inserting the following:
``(a) In General.--In each of'';
(2) by striking ``shall, subject to the availability of
appropriations for such purpose,'' and inserting ``shall''; and
(3) by adding at the end the following:
``(b) Assured Funding.--For each of fiscal years 2006 through 2010,
the Secretary of the Treasury shall make available to the Secretary of
Homeland Security the amount the Secretary of Homeland Security
determines is necessary to carry out subsection (a) for such fiscal
year. Each such amount is available, without fiscal year limitation, to
carry out subsection (a).''.
