Tribal Border Crossing Parity Act
This bill provides the right to pass the borders of the United States (which confers the right to certain public benefits and other privileges pursuant to the Jay Treaty) to an American Indian born in the United States or Canada who is a member, or is eligible to be a member, of a federally recognized Indian tribe in the United States or Canada. Current law instead provides this right to an American Indian who was born in Canada and who has at least 50% American Indian blood.

A BILL
To amend the Immigration and Nationality Act with respect to members of
a federally recognized Indian Tribe in the United States or Canada.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Tribal Border Crossing Parity Act''.
SEC. 2. MEMBERS OF A FEDERALLY RECOGNIZED INDIAN TRIBE IN THE UNITED
STATES OR CANADA.
Section 289 of the Immigration and Nationality Act (8 U.S.C. 1359)
is amended--
(1) by inserting ``or the United States'' after ``born in
Canada''; and
(2) by striking ``who possess at least 50 per centum of
blood of the American Indian race.'' and inserting ``who are
members, or are eligible to be members, of a federally
recognized Indian Tribe in the United States or Canada.''.
