Lady Liberty Act of 2023
This bill sets a floor of 125,000 for the maximum number of refugees who may be admitted into the United States each fiscal year. Under current law, the President sets the annual cap on refugee admissions at the beginning of each fiscal year. (The cap for FY2023 was 125,000, but in some years it had been lower. For example, the cap for FY2021 was 15,000.)

A BILL
To amend the Immigration and Nationality Act to provide for a minimum
number of refugees who may be admitted in any fiscal year after fiscal
year 2024, and for other purposes.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Lady Liberty Act of 2023''.
SEC. 2. MINIMUM NUMBER OF REFUGEES TO BE ADMITTED.
Section 207(a) of the Immigration and Nationality Act (8 U.S.C.
1157(a)) is amended by inserting after ``in any fiscal year after
fiscal year 1982 shall be such number as the President determines,''
the following: ``except that in any fiscal year after fiscal year 2024,
such number may not be less than 125,000, without regard to whether or
not the President makes any determination''.
