This bill requires Medicaid programs in U.S. territories to offer Medicare cost-sharing assistance for qualifying beneficiaries. Amounts expended for this purpose are excluded from Medicaid funding caps.

A BILL
To amend title XVIII of the Social Security Act to make the Medicare
Savings Program available in all jurisdictions.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Fairness in Medicare Savings Program
Act of 2023''.
SEC. 2. EXPANDING THE MEDICARE SAVINGS PROGRAM TO THE TERRITORIES.
(a) In General.--Section 1905(p)(4) of the Social Security Act (42
U.S.C. 1396d(p)(4)) is amended by inserting ``for fiscal years through
2023'' after ``Columbia)''.
(b) Nonapplication of Funding Cap.--Section 1108(g)(4) of the
Social Security Act (42 U.S.C. 1308(g)(4)) is amended by adding at the
end the following new subparagraph:
``(C) Exclusion relating to medicare cost-
sharing.--Payments under section 1903 for medical
assistance consisting of medicare cost-sharing (as
defined in section 1905(p)(3)) furnished on or after
October 1, 2023, shall not be taken into account in
applying any limit under subsection (f) or this
subsection.''.
