 To amend title 10, United States Code, to modify the authority of the 
Secretary of Defense to carry out the defense laboratory modernization 
                                program.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ``Defense Capability Development Minor 
Construction Enhancement Act of 2023''.

SEC. 2. MODIFICATION OF AUTHORITY TO CARRY OUT DEFENSE LABORATORY 
              MODERNIZATION PROGRAM.

    Section 2805(g)(1) of title 10, United States Code, is amended in 
subparagraph (D) by inserting ``or development, production, and 
sustainment of combat capabilities'' before the period at the end.
