Grant Relief for American Children's Elevation Act of 2023 or the GRACE Act
This bill establishes that an exceptional and extremely unusual hardship includes a hardship resulting from a removal (or deportation) that separates the individual subject to removal from a family member who is a U.S. citizen, a lawful permanent resident, or lawfully admitted into the United States.
Under current law, the Department of Homeland Security may cancel the removal of a non-U.S. national (alien under federal law) if the removal would result in an exceptional and extremely unusual hardship to an immediate relative who is a U.S. citizen or lawful permanent resident.

A BILL
To amend the Immigration and Nationality Act to establish certain
family separation as an exceptional and extremely unusual hardship, and
for other purposes.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Grant Relief for American Children's
Elevation Act of 2023'' or the ``GRACE Act''.
SEC. 2. EXCEPTIONAL AND EXTREMELY UNUSUAL HARDSHIP.
Section 240A(b) of the Immigration and Nationality Act (8 U.S.C.
1229b) is amended by adding at the end the following:
``(7) Exceptional and extremely unusual hardship defined.--
In this subsection, the term `exceptional and extremely unusual
hardship' shall include hardship resulting from separating a
family member who is a United States citizen, a lawful
permanent resident or an individual lawfully admitted to the
United States and a family member who is subject to deportation
or removal from the United States.''.
