Mrs. Fischbach (for herself and Mr. Pence) introduced the following
bill; which was referred to the Committee on Ways and Means, and in
addition to the Committee on Energy and Commerce, for a period to be
subsequently determined by the Speaker, in each case for consideration
of such provisions as fall within the jurisdiction of the committee
concerned

A BILL
To prohibit the Secretary of Health and Human Services from finalizing
a proposed rule regarding minimum staffing for nursing facilities, and
to establish an advisory panel on the skilled nursing facility
workforce.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Protecting America's Seniors' Access
to Care Act''.
SEC. 2. PROHIBITION ON FINALIZING PROPOSED STAFFING RULE.
The Secretary of Health and Human Services may not implement,
enforce, or otherwise give effect to the proposed rule entitled
``Medicare and Medicaid Programs; Minimum Staffing Standards for Long-
Term Care Facilities and Medicaid Institutional Payment Transparency
Reporting'' published by the Department of Health and Human Services on
September 6, 2023 (88 Fed. Reg. 61352-61429), and may not promulgate
any substantially similar rule.
