A BILL
To amend title 10, United States Code, to ensure that medical records
of the Department of Defense indicate the organizational affiliation of
certain health care providers.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Private Smither Act of 2024''.
SEC. 2. IDENTIFICATION IN PATIENT MEDICAL RECORDS OF AFFILIATION OF
CERTAIN NON-DEPARTMENT OF DEFENSE HEALTH CARE PROVIDERS.
Chapter 55 of title 10, United States Code, is amended by inserting
after section 1091 the following new section:
``Sec. 1091a. Identification in patient medical records of affiliation
of certain non-Department of Defense health care
providers
``(a) In General.--The Secretary of Defense shall ensure that
medical records of the Department of Defense include the organizational
affiliation of any covered health care provider identified in such
medical records.
``(b) Covered Health Care Provider Defined.--In this section, the
term `covered health care provider' means a health care provider who is
not--
``(1) a member of the uniformed services;
``(2) an employee of the Department of Defense;
``(3) an employee of another agency of the Federal
Government detailed to the Department of Defense;
``(4) a personal services contractor under section 1091 of
this title; or
``(5) a volunteer under section 1588 of this title.''.
