DRIVE Act

Deregulating Restrictions on Interstate Vehicles and Eighteen-wheelers Act or the DRIVE Act

This bill prohibits the Federal Motor Carrier Safety Administration (FMCSA) from issuing any rule or regulation to require vehicles that have a gross vehicle weight of more than 26,000 pounds and are operating in interstate commerce to be equipped with a speed limiting device set to a maximum speed. The FMCSA issued an advance notice of supplemental proposed rulemaking on this subject on May 4, 2022.

   To prohibit the Administrator of the Federal Motor Carrier Safety 
  Administration from issuing a rule or regulation requiring certain 
  vehicles to be equipped with speed limiting devices, and for other 
                               purposes.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ``Deregulating Restrictions on 
Interstate Vehicles and Eighteen-wheelers Act'' or the ``DRIVE Act''.

SEC. 2. PROHIBITION ON REQUIRING SPEED LIMITING DEVICES.

    Notwithstanding any other provision of law, the Administrator of 
the Federal Motor Carrier Safety Administration may not issue any rule 
or regulation to require vehicles with a gross vehicle weight of more 
than 26,000 pounds operating in interstate commerce to be equipped with 
a speed limiting device set to a maximum speed.
