Provides, under the Freedom of Information Act, that whenever either House of Congress, any committee thereof, or the Comptroller General of the United States requests an agency to make available information within its possession or under its control, the head of such agency shall make the information available as soon as practicable but not later than thirty days from the date of the request unless such information is exempt from disclosure under criteria established by statute or rules of Federal court procedure, or in the interim a statement is submitted by the President or by an agency head signed by the President invoking executive privilege as the basis upon which the information is being refused.
Requires that executive privilege shall be invoked only by the President in a signed written statement in which the factual circumstances justifying the invocation of the claim are described, and only in those instances in which (a) the requested testimony or documents contain policy recommendations made directly to the President or agency head, and (b) disclosure of such information would seriously jeopardize the national interest and his ability or that of the agency head to obtain candid and forthright advice.
