IN THE HOUSE OF REPRESENTATIVES July 17, 1989 Mr. MCNULTY (for himself and Mr. EMERSON) introduced the following bill; which was referred to the Committee on House Administration A BILL To provide for the design and construction of a Goddess of Democracy Statue, and for other purposes. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. ESTABLISHMENT OF GODDESS OF DEMOCRACY STATUE COMMISSION. (a) ESTABLISHMENT- There is established the Commission on the Goddess of Democracy Statue (hereafter in this Act referred to as the `Commission'). The members of the Commission shall be appointed as provided in subsection (c). (b) DUTIES OF COMMISSION- The Commission shall-- (1) solicit proposals for a design of the statue described in section 2; (2) select, in accordance with Public Law 99-652 (40 U.S.C. 1001-1010; relating to the standards for placing commemorative works in the District of Columbia), a design and site for such a statue; (3) erect the statue on Federal land in the District of Columbia; and (4) promote the establishment of the statue and encourage donations for the design and construction of the statue. (c) Membership of Commission- (1) IN GENERAL- The Commission shall consist of 12 members appointed by the Speaker and the Minority Leader of the House of Representatives and the President pro tempore and Minority Leader of the Senate, each of whom shall appoint 3 members. (2) TERM; VACANCIES- Members shall be appointed for the life of the Commission. A vacancy on the Commission shall be filled in the manner in which the original appointment was made. (d) DONATIONS- The Commission may solicit and accept from private and non-Federal, public sources funds to be used in carrying out this Act. For the purposes of Federal income, estate, and gift taxes, any gift, bequest, or devise accepted by the Commission shall be deemed to be a gift, bequest, or devise to or for the use of the United States. SEC. 2. GODDESS OF DEMOCRACY STATUE. (a) DESIGN- The design of the statue authorized to be erected by section 1(b)(3) shall be based on and resemble the statue displayed in June 1989 by prodemocracy demonstrators in Tiananmen Square, Beijing, People's Republic of China and called the `Goddess of Democracy' by the demonstrators. Other aspects of the design, such as its display and size, shall be decided as provided in section 1(b)(2). (b) DISPLAY- Subject to subsection (c), the statue authorized to be erected by section 1(b)(3) shall be displayed on Federal land in the District of Columbia on a site selected in accordance with Public Law 99-652 (40 U.S.C. 1001-1010). (c) OFFER OF STATUE TO THE CHINESE PEOPLE- When the President determines that the Government of the People's Republic of China will respect the democratic principles that lead to the display of the original Goddess of Democracy statue, the President may offer the statue established by this Act to the Chinese people to be displayed in China. (d) MAINTENANCE AND CARE- The maintenance and care of the statue authorized to be erected by section 1(b)(3), while it is being displayed in the District of Columbia, shall be the responsibility of the head of the department or agency responsible for the grounds upon which the statue is displayed. SEC. 3. FUNDING OF DESIGN AND CONSTRUCTION OF STATUE. Funds required to carry out this Act shall come solely from donations made to the Commission and Federal funds shall not be available for that purpose.
