IN THE HOUSE OF REPRESENTATIVES March 13, 1990 Mr. OLIN introduced the following bill; which was referred to the Committee on Agriculture A BILL To amend the Agricultural Act of 1949 with respect to the level of milk price support in effect for 1991 through 1995. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. SHORT TITLE. This Act may be cited as the `Dairy Stabilization Act of 1990'. SEC. 2. AMENDMENTS TO THE AGRICULTURAL ACT OF 1949. Paragraph (1) of section 201(d) of the Agricultural Act of 1949 (7 U.S.C. 1446(d)(1)) is amended-- (1) by redesignating paragraphs (2) through (7) as paragraphs (3) through (8), respectively, and (2) to read as follows: `(2)(A) Notwithstanding any other provision of law, during the period beginning January 1, 1991, and ending December 31, 1995, the price of milk shall be supported as provided in this paragraph. `(B) Except as provided in subparagraphs (C), (D), and (E), during the period beginning January 1, 1991, and ending December 31, 1991, the price of milk shall be supported at a rate equal to $10.10 per hundredweight for milk containing 3.67 percent milkfat. `(C) If for calendar year 1991, 1992, 1993, 1994, or 1995, the level of purchases of milk and the products of milk under this paragraph (less sales under section 407 for unrestricted use), as estimated by the Secretary on January 1 of such calendar year will contain-- `(i) in excess of both 260,000,000 pounds of milkfat and 600,000,000 pounds of nonfat solids (the amounts contained in 7,000,000,000 pounds of milk); or `(ii) more than either 370,000,000 pounds of milkfat or 860,000,000 pounds of nonfat solids (the amounts contained in 10,000,000,000 pounds of milk); the Secretary shall decrease by 50 cents per hundredweight the rate of price support for milk as in effect on such date. `(D) If for calendar year 1991, 1992, 1993, 1994, or 1995 the level of purchases of milk and the products of milk under this paragraph (less sales under section 407 for unrestricted use), as estimated by the Secretary on January 1 of such calendar year will contain less than both 130,000,000 pounds of milkfat and 300,000,000 pounds of nonfat solids (the amounts contained in 3,500,000,000 pounds of milk), the Secretary shall increase by 50 cents per hundredweight the rate of price support for milk as in effect on such date. `(E) If for calendar year 1991, 1992, 1993, 1994, or 1995 the level of purchases of milk and the products of milk under this paragraph (less sales under section 407 for unrestricted use), as estimated by the Secretary on January 1 of such calendar year will contain in excess of either 440,000,000 pounds of milkfat or 1,030,000,000 pounds of nonfat solids (the amounts contained in 12,000,000,000 pounds of milk), the Secretary may implement additional production adjustment measures to bring purchases under this paragraph below such levels. Such measures may include decreasing, by an amount not to exceed 25 cents per hundredweight, the rate of price support for milk as in effect on such date and after decreasing such rate if required by subparagraph (C). `(F) If for calendar year 1991, 1992, 1993, 1994, or 1995-- `(i) the level of purchases of milk and the products of milk under this paragraph (less sales under section 407 for unrestricted use), as estimated by the Secretary on January 1 of such calendar year will contain in excess of either 260,000,000 pounds of milkfat or 600,000,000 pounds of nonfat solids (the amounts contained in 7,000,000,000 pounds of milk); and `(ii) the levels of milkfat and nonfat solids contained in such purchases are not proportional to those components in whole milk; the Secretary shall adjust the prices at which the Secretary purchases milkfat and nonfat solids, to better reflect the relative market values of those components in milk. `(G) The price of milk shall be supported through the purchase of milk and the products of milk.'. SEC. 3. EFFECTIVE DATE. This Act and the amendments made by this Act shall take effect on January 1, 1991.
