United States Flag Cruise Ship Safety and Competitiveness Act of 1990 - Repeals The Gambling Ship Act (relating to gambling ships and, without reference to ships, transmission of wagering information).
Declares that provisions of Federal law relating to the transportation of gambling devices do not apply to any vessel documented as a vessel of the United States.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. SHORT TITLE. This Act may be cited as `The United States Flag Cruise Ship Safety and Competitiveness Act of 1990'. SEC. 2. DEFINITIONS. For the purpose of this Act-- (1) `gambling ship' means a vessel, regardless of tonnage, that can accommodate more than six passengers, and-- (A) carries and operates gambling devices for the use of its passengers, or (B) otherwise provides facilities for the purpose of gaming or gambling, including accepting, recording, or registering bets, or carrying on a policy game or any other lottery, or playing any game of chance, for money or other thing of value. (2) `vessel' includes every kind of water craft or other contrivance used or capable of being used as a means of transportation on water, as well as any ship, boat, barge, or other water craft or any structure capable of floating on the water. (3) `documented vessel' has the same meaning as in chapter 121 of title 46, United States Code. SEC. 3. REPEAL. Chapter 50 of title 18, U.S.C. `The Gambling Ship Act' is repealed. SEC. 4. CONFORMING AMENDMENT. The Act of January 2, 1951, ch. 1194, as amended, (Transportation of Gambling Devices) does not apply to any vessel documented as a vessel of the United States under chapter 121 of title 46, U.S.C. SEC. 5. EFFECTIVE DATE. The provisions of this act shall be effective one hundred and eighty days after date of enactment.
