Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. CLAIMS. (a) JURISDICTION OVER CLAIMS- The United States Claims Court shall have jurisdiction to hear, determine, and render judgment upon any claim by Dallas M. Patterson for retroactive retirement pay wrongfully withheld from him because of a failure of the United States Army to promote him from the rank of Lieutenant Colonel to Colonel, notwithstanding-- (1) any statute of limitations pertaining to suits against the United States, or lapse of time, or bar of laches; or (2) any provision of law that provides that the United States Claims Court lacks jurisdiction over claims for back pay and correction of records made by a person who has voluntarily retired from the armed services of the United States. (b) LIMITATION ON SUITS- Any suit upon a claim brought under subsection (a) may be instituted within one year after the date of enactment of this Act. Nothing in this Act shall be construed as an admission or inference of liability on the part of the United States. Except as provided in this Act, proceedings for the determination of a claim brought under subsection (a), and the review and payment of a judgment or judgments on such a claim, shall be handled in the same manner as in the case of a claim over which the United States Claims Court has jurisdiction under section 1491 of title 28, United States Code.
